These Terms of Service (“Terms”) govern your access to and use of houseofhendler.com and your purchase of products from House of Hendler (“House of Hendler,” “we,” “us,” or “our”).
By using the website, placing a retail order, or submitting a wholesale order request, you agree to these Terms. If you do not agree, please do not use the website or place an order.
1. Website Use
You may use the website only for lawful personal or business purposes and in accordance with these Terms.
You are responsible for ensuring that information you provide in connection with an order, contact request, or wholesale request is accurate, complete, and current.
You must be legally capable of entering into a binding agreement. If you are using the website on behalf of a business, you represent that you have authority to bind that business.
We may modify, suspend, or discontinue any part of the website when reasonably necessary, subject to applicable law.
2. Products
House of Hendler sells needlepoint accessories and related products through the website.
We make reasonable efforts to display product descriptions, colors, dimensions, photographs, and other details accurately. Colors and appearance may vary depending on lighting, photography, manufacturing variations, and screen settings. Minor variations that do not materially affect the product’s intended use are not necessarily defects.
Product packaging may change from time to time without notice, provided the product itself remains materially as described.
3. Orders and Payments
Retail purchases are completed through Stripe-hosted checkout pages. By submitting a payment, you also agree to any applicable Stripe terms presented during checkout.
Payment is due at the time a retail order is placed. Stripe processes your payment information; House of Hendler does not directly process or store complete payment-card numbers on its website.
An order confirmation acknowledges that we received your order. We reserve the right to reject or cancel an order before shipment if:
- A product is unavailable
- Pricing or product information contains a material error
- Payment cannot be authorized
- We reasonably suspect fraud or unauthorized activity
- The order violates these Terms or applicable law
- We cannot fulfill the order for another legitimate business reason
If we cancel a paid order, we will refund the amount charged for the canceled item or order.
4. Pricing and Taxes
Prices are shown in U.S. dollars and may change without notice. A price change does not affect an order that has already been accepted and paid, except where correction is required by law or the displayed price resulted from an obvious error.
Applicable taxes are calculated during Stripe checkout. Shipping charges are displayed before payment. The current retail checkout generally applies a $5 shipping charge and is limited to U.S. shipping addresses.
We do not offer a retroactive price adjustment merely because a product’s price changes after an order is placed.
5. Product Availability
Products and quantities are subject to availability. Placing an item in a cart or opening a checkout page does not reserve inventory.
We may limit purchase quantities, discontinue products, or deactivate a checkout link when inventory is exhausted. If an unavailable product is purchased because of a technical or inventory error, we may cancel and refund the affected item or order.
6. Retail Processing and Shipping
Retail orders are generally processed within 1–3 business days. Business days exclude weekends and federal holidays.
Orders are generally shipped through USPS. Typical delivery is approximately 3–7 business days after shipment. Processing and delivery dates are estimates and are not guaranteed.
Carrier delays, severe weather, service interruptions, address errors, and other circumstances outside our reasonable control may affect delivery. Please ensure that your shipping address is complete and accurate before submitting payment.
Contact heather@houseofhendler.com promptly if you discover an address error. We cannot guarantee that an address can be changed after an order has entered processing or shipment.
7. Retail Returns and Refunds
Eligible retail products may be returned within 14 days after delivery.
To qualify for a return, a product must be:
- Unused
- Undamaged
- In its original packaging
- Returned with sufficient order information to identify the purchase
To request a return, email heather@houseofhendler.com before sending the item. Please include your name, order information, the item you wish to return, and the reason for the request.
Customers are responsible for return-shipping costs unless the product received was damaged, defective, or incorrect. Original shipping charges are nonrefundable.
We do not offer direct exchanges. You may return an eligible item and place a separate order for the replacement product you want.
Returned products will be inspected. If the return is eligible, the applicable refund will be issued to the original payment method. We may deny or reduce a refund when a returned product does not satisfy the requirements above, to the extent permitted by law.
Nothing in this section limits rights that cannot legally be waived.
8. Damaged, Defective, Incorrect, or Incomplete Orders
Damaged, defective, incorrect, or incomplete orders must be reported within 5 days after delivery.
Email heather@houseofhendler.com and provide:
- Your name and order information
- A description of the problem
- Photographs of the product and packaging when applicable
We will review the information and provide an appropriate remedy based on the circumstances, product availability, and applicable law. Do not discard the product or packaging until we have reviewed the claim.
9. Wholesale Orders
Submitting a wholesale form is an order request and does not, by itself, create an accepted order.
Wholesale requests are subject to review, current trade pricing, product availability, opening or reorder minimums, resale-document verification, and acceptance by House of Hendler. Shipping or approved local-delivery charges are calculated separately and included in the final invoice.
A wholesale order is finalized when the final invoice is paid, unless the invoice or a separate written agreement states otherwise.
Wholesale orders are final sale, except when merchandise is damaged, defective, or incorrect. A wholesale customer must contact heather@houseofhendler.com promptly after delivery with the invoice or order information and photographs when applicable.
The terms stated on an accepted wholesale invoice or separate written wholesale agreement control if they conflict with these general Terms.
10. Intellectual Property
The website and its content—including House of Hendler’s name, logos, product designs, artwork, photographs, graphics, text, page design, and branding—are owned by House of Hendler or used with permission and are protected by intellectual-property laws.
You may view the website and make purchases for their intended purposes. You may not copy, reproduce, distribute, modify, publish, sell, create derivative works from, or commercially exploit website content or House of Hendler intellectual property without prior written permission.
Purchasing a product does not transfer any intellectual-property rights in the product design, artwork, branding, packaging, or associated content.
11. Prohibited Uses
You may not:
- Use the website for unlawful, fraudulent, or deceptive activity
- Interfere with the website’s operation or security
- Attempt to gain unauthorized access to the website, its systems, or related accounts
- Introduce malware, harmful code, automated scraping tools, or disruptive technology
- Misrepresent your identity, authority, or affiliation
- Submit false payment, resale, shipping, or contact information
- Infringe House of Hendler’s or another person’s intellectual-property or privacy rights
- Use website content or product imagery for unauthorized commercial purposes
- Circumvent purchase limits or checkout restrictions
We may restrict access, reject orders, or take appropriate action when we reasonably believe these Terms have been violated.
12. Third-Party Services and Links
The website uses or links to third-party services, including Stripe, USPS, MailerLite, FormSubmit, GitHub Pages, and social-media platforms.
Those services are operated under their own terms and privacy policies. House of Hendler is not responsible for a third party’s independent acts, omissions, availability, security, or content, except to the extent responsibility cannot be excluded by law.
A link to a third-party website does not imply endorsement of all content, products, or practices on that website.
13. Disclaimer of Warranties
To the fullest extent permitted by law, the website and its content are provided on an “as is” and “as available” basis.
We do not warrant that the website will always be available, uninterrupted, secure, or error-free. We do not make warranties beyond those expressly stated in a product description or required by applicable law.
This disclaimer does not exclude any warranty or consumer right that cannot legally be waived.
14. Limitation of Liability
To the fullest extent permitted by law, House of Hendler and its owner, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website, inability to use the website, third-party services, or a product purchase.
To the fullest extent permitted by law, House of Hendler’s aggregate liability arising from a particular order or transaction will not exceed the amount paid to House of Hendler for the product or order giving rise to the claim.
These limitations do not apply where liability cannot legally be limited, including liability resulting from conduct for which exclusion is prohibited by applicable law.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold House of Hendler harmless from claims, losses, liabilities, and reasonable expenses arising from your unlawful misuse of the website, infringement of another person’s rights, submission of fraudulent information, or material violation of these Terms.
This section does not require a consumer to indemnify House of Hendler for House of Hendler’s own unlawful conduct.
16. Events Outside Our Control
We are not responsible for delay or failure caused by circumstances reasonably outside our control, including carrier disruptions, severe weather, natural disasters, labor interruptions, utility or network failures, governmental actions, supply interruptions, or other force-majeure events.
We will make reasonable efforts to communicate material fulfillment problems and provide any remedy required by applicable law.
17. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.
Subject to any rights that cannot be waived under applicable consumer law, disputes relating to these Terms, the website, or an order will be brought in the state or federal courts with jurisdiction in Philadelphia County, Pennsylvania. You and House of Hendler consent to the jurisdiction of those courts.
18. Severability and Waiver
If a provision of these Terms is found unenforceable, the remaining provisions will continue in effect, and the unenforceable provision will be enforced to the maximum extent permitted by law.
A failure to enforce a provision is not a waiver of the right to enforce it later.
19. Changes to These Terms
We may update these Terms to reflect changes in our practices, services, or legal obligations. Revised Terms will be posted on this page with an updated effective date.
Changes apply prospectively from the date they are posted unless otherwise stated or required by law. Terms applicable when an order was placed generally continue to govern that order.
